Terms of Service

1. Acceptance of Terms

By creating an account or using BeanWhisperer ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by Dot and Drape LLC, a Delaware limited liability company ("we," "us," or "our").

2. Description of Service

BeanWhisperer is an AI-powered espresso profile suggestion tool. It uses third-party artificial intelligence services to analyze coffee bean descriptions and generate extraction profile recommendations for compatible espresso machines. The Service is an advisory tool — it does not certify, test, or guarantee the safety or suitability of generated profiles for any specific machine or use case.

3. Account Terms

• You must provide a valid email address to create an account.
• One account per person. Accounts are non-transferable.
• You are responsible for maintaining the security of your account and any activity that occurs under it.
• You must be at least 16 years old to use the Service.

4. Subscription and Billing

BeanWhisperer offers a free tier (5 chats per month) and a paid Pro tier ($5.00 USD per month, 500 chats per month).

• Auto-renewal: Pro subscriptions automatically renew each month until cancelled. You will be charged on the same date each billing cycle.
• Cancellation: You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will not be charged for the next period after cancellation.
• Refunds: We do not provide refunds for partial billing periods. If you believe you were charged in error, contact us within 14 days. For EU customers: you have a 14-day right of withdrawal from the date of subscription, provided you have not used the Service during that period. By subscribing and using the Service immediately, you acknowledge that you waive this right of withdrawal.
• Price changes: We will notify you at least 30 days before any price increase via the email associated with your account.

5. Machine Integration Disclaimer

IMPORTANT: Please read this section carefully.

BeanWhisperer can generate espresso extraction profiles that may be pushed to compatible espresso machines over your local network. These profiles control machine parameters including pressure, temperature, and flow rate.

• Generated profiles are recommendations only. You are solely responsible for reviewing any profile before applying it to your machine.
• Incorrect parameters could cause equipment malfunction, excessive wear, or damage.
• You should verify all generated parameters are within your machine's rated operating specifications.
• BeanWhisperer does not validate profiles against your specific machine's hardware limits beyond basic safety bounds.
• BeanWhisperer is not affiliated with, endorsed by, or certified by GaggiMate or any espresso machine manufacturer.

To the maximum extent permitted by law, BeanWhisperer shall not be liable for any damage to equipment, property, or person arising from the use of generated profiles. You use the machine integration feature entirely at your own risk.

6. AI-Generated Content

BeanWhisperer uses third-party artificial intelligence services to generate espresso profile recommendations. AI-generated content may be inaccurate, incomplete, or unsuitable for your specific equipment, beans, or preferences. All recommendations should be treated as suggestions, not expert advice. We do not guarantee the accuracy, safety, or quality of AI-generated profiles.

7. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use automated scripts, bots, or scrapers to access the Service.
• Resell, redistribute, or commercially exploit generated profiles without permission.
• Attempt to circumvent rate limits or usage restrictions.
• Use the Service for any unlawful purpose.

8. Intellectual Property

We own all rights to the Service, its design, and its underlying technology. You retain ownership of the coffee descriptions and tasting notes you provide. Generated espresso profiles are licensed to you for personal, non-commercial use. Because the same inputs may produce similar outputs for other users, generated profiles are not exclusively owned by any single user.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or equipment.

10. Indemnification

You agree to indemnify and hold harmless Dot and Drape LLC from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, including but not limited to applying generated profiles to espresso machines or any violation of these Terms.

11. Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered under streamlined arbitration rules, conducted individually (not as a class action). Either party may bring claims in small claims court as an alternative. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or abuse of the Service. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 8, 9, 10, and 11 survive termination.

13. Modifications

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect via the email associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Miscellaneous

• If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• These Terms constitute the entire agreement between you and BeanWhisperer regarding the Service.
• Our failure to enforce any right or provision does not waive that right or provision.
